Litigation between fiduciaries is one of the fastest growing areas of the law. With the substantial across the board decline in asset values seen in 2008 and early 2009, serving as executor of a trustee has become an increasingly risky proposition. This teleconference helps those responsible for analyzing fiduciary issues understand the duties owed by a fiduciary, the remedies available to a beneficiary, and the defenses that exist for a fiduciary faced with a claim of breach. A large part of the discussion will focus on preventive measures to be taken by the fiduciary in the planning stage and during the administration process to reduce the risk of breach of fiduciary duty claims.
